Marisa Martin Teaches Painting: Terms & Conditions

Preamble: This is the 'small print'—but we hope we've made it big enough for you to read easily. We want you to enjoy and benefit from the courses we are offering. Please read these terms and conditions carefully; they are intended to clarify the agreement between us. If anything is not clear, please contact us for clarification before booking.

In the following terms and conditions, 'we' and 'us' and similar words indicate Marisa Martin, her employees and staff. 'You', 'the person making the booking', have their natural meaning.

  1. It is a condition of joining our courses that you are covered by adequate holiday insurance that includes medical, personal accident and cancellation cover and that you advise us of the fact of the insurance at the time of booking. Suitable insurance can be purchased at any travel agent or large supermarket. By making a booking with us you confirm to us that you and all persons you are booking for have arranged insurance covering at least these needs.

  2. The person making the booking and all other members of his/her party shall take full and sole responsibility for their safety and conduct and the safety and conduct of anyone for whom they are responsible. All reasonable care has been taken to ensure the safe use of the property and its contents.

  3. Once we receive a completed booking form together with a deposit of 150 Euros per person per week booked we will make a reservation for you. Upon receipt of cleared funds we will confirm the reservation in writing or by e-mail, as indicated by you. We will hold a provisional reservation open for seven days after a booking has been received by post, e-mail or telephone.

  4. Full payment must be received by us at least eight weeks prior to the departure date. If we do not receive full payment by the due date, we will assume the reservation to be cancelled and may reallocate places without advising you. If a reservation is booked within eight weeks of the departure date then the whole payment is due upon booking. Upon receipt of the completed booking form with full payment we will confirm the booking as in term [3] above.

  5. Amendments made up to seven weeks before departure will, if we are able to assist you with the required changes, incur an amendment fee of 20 Euros per person.

  6. Unless the booking is cancelled by us due to unforeseen or exceptional circumstances, all deposits are non-refundable. If you cancel the booking after you have paid the balance, we can only refund the balance paid to us if we succeed in re-letting the booking. We will endeavour to do this, but this cannot be guaranteed and often will not be possible.

  7. In the unlikely event of your course being cancelled by us owing to circumstances beyond our control, our liability is limited to the amount of money that you have paid to us only. It is required as term [1] of this contract that you take out holiday insurance cover against the possibility of cancellation.

  8. We reserve the right to modify or change the programme of the course or any other arrangements if this is found to be reasonably necessary, or due to circumstances beyond our control; an example would be because of extreme weather conditions. If this should be necessary, we will if we have advance knowledge of changes discuss them with you beforehand.

  9. We reserve the right to substitute course teachers in the event of circumstances beyond our control; an example would be if the teacher fell ill. In such circumstances we will provide another teacher and if we have advance knowledge of any changes you will be informed of the circumstances beforehand.

  10. We reserve the right to change the quoted prices and any other particulars stated on this web site and/or contract at any time before we enter into a contract with you. If there are any known changes we will inform you of them at the time of booking.

  11. We no longer book flights or accommodation on your behalf.  You are responsible for making your own travel and accommodation arrangements and paying for them. We can of course help you with this, but accept no responsibility for  

  12. Courses run for five half-days. Afternoons are free for you to do what you wish. Dates for courses shown on the availability calendar are nominal: courses will start on the day in a week when the majority of participants arrive. Courses may cross over. 

  13. Participants are responsible for their own transfer costs and arrangements.

  14. If you are without transport we will attempt to arrange (but without guarantee) no-charge transport from your accommodation to the painting centre and back on days when tuition is taking place at the painting centre, and similarly for field trips. You must be ready to leave at the time you are advised that the free transport will leave. If you miss the free transport you will be responsible for your own transport. You may in any case arrange your own transport if you prefer, and we prefer this too.

  15. We cannot be held responsible for any delays, loss of property, death or injury incurred because of any travel, including car transfers, transport and car trips on courses. Any expenses incurred will be the responsibility of the passenger.

  16. We cannot be held responsible for any loss or damage to personal items, or for personal accident, death or injury. Any trips or excursions you undertake are entered into at your own risk and therefore we advise you to have suitable insurance cover. It is stated as term [1] of this contract that you are required to take out suitable insurance cover.

  17. We do not accept responsibility for acts and/or omissions of our staff or employees whilst acting in the course of their employment. However, if there is a genuine complaint we will do our best to rectify the perceived problem. We cannot be held responsible for, or accept liability for, death, injury or illness caused to the person booking or any other person on the booking form, unless this arises from the proven negligence or omission of our staff or employees whilst acting in the course of their employment. Any claims shall be subject to Spanish law in respect of any question of liability or quantum, and all proceedings will be within the exclusive domain of the Spanish courts.

  18. If you have had any major physical or emotional illness within the past 5 years, or are under medical or psychiatric supervision, you must notify us of the details at the time of booking and, where appropriate, enclose a doctor's certificate of fitness to travel. Non-disclosure of relevant information can invalidate your insurance and cancel our contractual obligation to you.

  19. The teaching locations normally offered, as well as the painting centre itself and the field painting trips require normal mobility for full access. We do not wish to exclude anyone with a disability where it is feasible to accommodate their needs; please contact us in advance of booking to discuss whether the courses are suitable or feasible for someone with a specific disability.

  20. Please when booking the course notify us of any special dietary needs, medical warnings or any other requests. We will do our best to meet your requirements but we cannot guarantee that such requests will be met in full and we accept no liability if any such requests cannot be met.

  21. The normal courses are not intended for children, and we do not generally accept children onto the adult courses. For this purpose 'children' will be defined as individuals below the age of 18 years old. If you wish to make special arrangements for tuition of children this may (or may not) be possible in any particular time period, please contact us directly.

  22. The person booking must communicate any perceived failure in the performance of this contract to us immediately so that we can find a satisfactory solution at that time. If this is not possible, then you must make a complaint in writing within 28 days of the course being finished. We want you to enjoy your time with us and benefit from the tuition: please help us to help you achieve this by telling Marisa Martin of any problems immediately.

  23. The courses are being given in Province of Leon, generally in the countryside. Whilst Spain and Leon maintains a high standard of living, necessarily many services are not as available or reliable as in a major metropolitan area, and local practice may vary from UK practice. We regret that claims for unfortunate local conditions such as electricity cuts, water cuts, lack of hot water, smells, cleanliness or maid service standards, aircraft or other noise and any unforeseen inconveniences cannot be entertained and we will not be liable for compensation in these and similar circumstances. We will of course make every effort to resolve any such difficulties as quickly as possible: please notify us immediately of any problems.

  24. No smoking is permitted within our buildings or vehicles or grounds. Smoking in the grounds or wooded areas can be a major fire risk, especially in the summer months—it is essential at all times that smokers tidy up after themselves, picking up and extinguishing butt ends, and disposing of them safely in a suitable non-flammable rubbish container. In Spain it is a criminal offence to throw cigarette stubs into the road or out of a vehicle as there is high fire risk.

  25. You undertake to turn off your mobile telephone at our request whilst courses are being given, during mealtimes and at any time at the request of the course tutors whilst on our premises. This is because the use of mobile telephones can be very distracting to other course participants and the tutors.

  26. You are obliged to supply your own equipment and are responsible for insuring that equipment against damage or theft. If you hire equipment from us then you are responsible for that equipment and must return it in good condition or replace it if damaged.

  27. If we book any service, accommodation, excursion, or rent any vehicle or other facility at your request and on your behalf, we are merely acting as facilitative agents for you. Your contract is with the legal person offering the service, excursion or rental, not with us.

  28. Force Majeure: we cannot accept liability in any circumstances where performance and/or prompt performance of the contract is prevented by reason of war, threat of war, riots, civil strife, terrorist activities, industrial disputes, natural and nuclear disasters, fire or adverse weather conditions, epidemic or health risk, technical problems with aircraft or transport, closure or congestion of airports or ports, insolvency of airlines or any other similar events beyond our control.

  29. By signing the booking form, you are agreeing to accept all of the above conditions. The person who signs the booking form affirms that they do so on behalf of all the individuals included on it, so that all are bound by the booking terms and conditions stated here. Persons making payments without completing the booking form will be bound by these terms and conditions.
